Two songs in the San Marinese selection contain large samples of songs that have previously been released commercially before September 1, 2017.
Eurofestival News reports that two of the songs competing in 1in360, the San Marinese Eurovision selection may breach the rules of the Eurovision Song Contest. The site reports that the two songs performed by Irol at last weeks first semi-final contain samples of songs released commercially before September 1st 2017.
“Stuck without me”, includes a section “Decollo“, which was released in May 2017. While “Who we are” uses bars which were already used in “Cardiopalma“, which was released on August 1. All of the songs are not only available on YouTube but also on iTunes and the music streaming service Spotify.
It is not known whether San Marino RTV has received permission for the two songs to be eligible for this years contest in Lisbon. The rules of the contest state;
The compositions (lyrics and music) must not have been commercially released before 1 September 2017. In case the composition has been made available to the public, for example, but not limited to, on online video platforms, social networks or (semi-) publicly accessible databanks, the Participating Broadcaster must inform the ESC Executive Supervisor, who shall have authority to evaluate whether the composition is eligible for participation in the Event. In particular, the ESC Executive Supervisor shall assess whether such disclosure prior to the Release Date is likely to give to the composition an advantage in the Event vis-à-vis the other compositions. The ESC Executive Supervisor shall authorise or deny participation of a composition which may have been available to the public as described above, subject to the prior approval of the Reference Group.

San Marino in the Eurovision Song Contest
Over 9 years of participation San Marino have only once qualified for the Eurovision final when Valentina Monetta represented the country with “Maybe (Forse)” in Copenhagen. She finished in 24th place with 14 points, San Marino’s best result to date. This year Valentina represented her country for the 4th time, this time joined on stage by American singer Jimmie Wilson. The pair’s entry “Spirit of the Night” finished in last place in its semi-final in Kyiv, scoring just 1 point.
